1. Acceptance of Terms

By accessing, browsing, or using the Site in any manner, you acknowledge that you have read, understood, and agree to be bound by these Terms and by our Privacy Policy, available at trussfinancialgroup.com/privacy-policy. We may modify these Terms at any time. Changes take effect upon posting to the Site with an updated effective date. Your continued use of the Site after any change constitutes acceptance of the revised Terms.

2. Eligibility

The Site is intended for use by individuals who are at least 18 years of age and legally capable of entering into binding agreements. By using the Site, you represent and warrant that you meet these eligibility requirements. If you are using the Site on behalf of a business entity, you represent that you have the authority to bind that entity to these Terms.

3. Description of Services

Truss Financial is a mortgage brokerage specializing in residential lending solutions for self-employed borrowers and real estate investors. Through the Site, we provide:

• General information about our mortgage products and lending programs, including DSCR loans, bank statement loans, home equity lines of credit, and other non-QM products.
• Loan calculators and rate estimate tools for informational purposes.
• Rate quote request forms and loan inquiry submissions.
• A secure borrower portal for submitting and tracking loan applications.
• Educational content related to mortgage lending and real estate finance.
• AI-powered assistants and automated communications, including AI-initiated voice calls, AI- generated and AI-assisted SMS, and AI-powered chat experiences used to qualify, route, schedule, and support borrower inquiries.

4. No Guarantee of Loan Approval; Not a Commitment to Lend

Nothing on the Site constitutes a commitment, agreement, or guarantee to extend credit, approve a loan, or provide any specific terms, rates, or conditions. All loan programs, interest rates, fees, and terms displayed on the Site are subject to change without notice and are provided for informational purposes only. Rate quotes, pre-qualifications, and calculator results generated through the Site are estimates only and do not represent a formal loan offer, approval, or commitment. All loans are subject to credit approval, underwriting requirements, property appraisal, and applicable regulatory guidelines. Truss Financial Group is a mortgage broker and not a direct lender.

5. Use of Interactive Tools, Calculators, and AI Features

The Site may include interactive tools such as mortgage calculators, payment estimators, rate comparison features, and AI-powered chat assistants. These tools are provided for general informational and educational purposes only.

• Calculator results are estimates based on the information you input and current market assumptions. They are not guaranteed and may differ from actual loan terms.
• Rate quote forms collect preliminary information to assist our team in providing potential loan options. Submitting a form does not create a binding obligation on Truss Financial or on you.
• Outputs from AI-powered chat, voice agents, and other AI tools, including AI-generated rate estimates, summaries, and recommendations, are informational only and are not binding offers. AI outputs may contain errors, omissions, or outdated information. You should confirm any material fact, rate, or term with a licensed loan officer before making a financial decision.
• You are responsible for the accuracy, completeness, and truthfulness of all information you provide through any interactive tool, AI experience, or form on the Site.

6. Borrower Portal and Account Access

Certain areas of the Site, including the borrower portal, may require you to create an account or to log in using credentials. By creating or using an account, you agree to:

• Provide accurate, current, and complete information during registration and at all times thereafter.
• Maintain the confidentiality of your login credentials and not share them with any third party.
• Accept responsibility for all activity that occurs under your account.
• Notify us immediately of any unauthorized access to or use of your account.

We reserve the right to suspend or terminate your account at any time if we reasonably believe your account has been compromised, that you have violated these Terms, or that continued access poses a risk to the Site, to other users, or to Truss Financial.

7. AI-Powered Communications and Voice Agents

Truss Financial uses automated systems, including AI-powered voice agents, AI-assisted SMS, and AI chat, to communicate with prospective borrowers, current borrowers, and the general public. By engaging with the Site or with any of our communications channels, you acknowledge and agree to the following.

A. Identification of AI Systems

AI voice agents and AI-driven SMS systems operated by or on behalf of Truss Financial will identify themselves as automated at the start of an interaction, or in response to your direct question, in accordance with applicable state and federal disclosure laws.

B. Recording, Transcription, and Analysis

Inbound and outbound calls, whether placed by a human employee or by an AI voice agent, may be recorded, transcribed, and analyzed by AI systems for quality assurance, training, dispute resolution, fraud prevention, and regulatory compliance, as described more fully in our Privacy Policy. Notice and consent will be provided at the start of the call.

C. Right to Human Interaction

You may request to speak with a live employee at any time during an interaction with one of our AI systems. We will route you to a human as promptly as reasonably practicable. Your request to speak with a human will not be used as a basis to deny you any product, service, or assistance.

D. Reliance on AI Outputs

AI-generated responses, summaries, recommendations, schedules, and other outputs are provided as a convenience and are not a substitute for advice from a licensed loan officer or other qualified professional. You should not rely solely on AI outputs in connection with any material financial decision.

8. Prohibited Conduct

You agree not to use the Site for any unlawful purpose or in any manner that could damage, disable, overburden, or impair the Site. Specifically, you agree not to:

• Submit false, misleading, or fraudulent information through any form, application, AI interaction, or tool on the Site.
• Attempt to gain unauthorized access to any portion of the Site, our systems, or any connected networks.
• Use automated scripts, bots, crawlers, scraping tools, or AI systems to access, collect, harvest, train on, or extract data from the Site or our AI experiences, in each case without our prior written consent.
• Interfere with or disrupt the integrity, security, or performance of the Site or its underlying infrastructure.
• Upload, transmit, or distribute any viruses, malware, or other harmful code.
• Use the Site to harvest the personal information of other users or third parties.
• Impersonate any person or entity, or misrepresent your affiliation with any person or entity, in any communication with our AI systems or human staff.
• Reproduce, duplicate, copy, sell, resell, or exploit any portion of the Site, or the outputs of our AI systems, for commercial purposes without our express written permission.

9. Intellectual Property

All content on the Site, including text, graphics, logos, images, videos, software, trademarks, trade names, page layouts, and the outputs of our AI systems, is the property of Truss Financial Group, LLC or its licensors, and is protected by United States and international copyright, trademark, and other intellectual property laws.

The names "Truss Financial Group," "Equity Access Group," "VA Loan Headquarters," and all associated logos, taglines, and branding are trademarks or service marks of Truss Financial Group, LLC. You may not use, reproduce, or distribute any of our trademarks without prior written consent.

Subject to your compliance with these Terms, you are granted a limited, non-exclusive, non- transferable, revocable license to access and use the Site for personal, non-commercial purposes. This license does not include the right to use any portion of the Site or any output of our AI systems to train, fine-tune, evaluate, benchmark, or otherwise develop any artificial intelligence model or system.

10. Third-Party Links and Services

The Site may contain links to third-party websites, applications, or services that are not owned or controlled by Truss Financial. We do not control and are not responsible for the content, privacy practices, accuracy, or availability of any third-party site or service. Inclusion of a link does not imply endorsement or affiliation. Your use of any third-party site or service is at your own risk and is subject to that third party’s terms and policies.

11. Disclaimers

THE SITE AND ALL CONTENT, TOOLS, AI EXPERIENCES, AND SERVICES PROVIDED THROUGH IT ARE OFFERED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, TRUSS FINANCIAL DISCLAIMS ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ACCURACY.

We do not warrant that the Site or any AI feature will be uninterrupted, error-free, secure, accurate, complete, current, or free of viruses or other harmful components. We do not guarantee the accuracy, completeness, or timeliness of any information, rate, calculation, AI-generated response, or other content displayed on the Site.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, TRUSS FINANCIAL GROUP, LLC, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AFFILIATES, AND LICENSORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF OR INABILITY TO USE THE SITE OR ANY AI FEATURE, INCLUDING LOSS OF REVENUE, PROFITS, DATA, OR BUSINESS OPPORTUNITIES, REGARDLESS OF THE THEORY OF LIABILITY.

IN NO EVENT SHALL OUR TOTAL AGGREGATE LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THE SITE OR THESE TERMS EXCEED ONE HUNDRED DOLLARS ($100.00).

13. Indemnification

You agree to indemnify, defend, and hold harmless Truss Financial Group, LLC, its officers, directors, employees, agents, affiliates, and licensors from and against any claims, liabilities, damages, losses, costs, and expenses, including reasonable attorneys’ fees, arising out of or related to (a) your use of the Site or any AI feature; (b) your violation of these Terms; (c) your violation of any applicable law or regulation; or (d) any information you submit through the Site or any of our communications channels.

14. Dispute Resolution and Binding Arbitration

A. Agreement to Arbitrate

You and Truss Financial agree that any dispute, claim, or controversy arising out of or relating to these Terms, the Site, or any service or AI feature provided by Truss Financial (each a "Dispute") shall be resolved exclusively through final and binding arbitration, rather than in court, except that either party may bring an individual claim in small claims court if the claim qualifies.

B. Arbitration Rules and Forum

Arbitration will be administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules then in effect. Arbitration will take place in the State of California, unless the parties mutually agree to an alternative location or to a virtual proceeding. The arbitrator’s decision will be final and binding and may be entered as a judgment in any court of competent jurisdiction.

C. Class Action Waiver

YOU AND TRUSS FINANCIAL AGREE THAT EACH PARTY MAY BRING DISPUTES AGAINST THE OTHER ONLY IN AN INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTION. IF THIS CLASS ACTION WAIVER IS FOUND TO BE UNENFORCEABLE, THEN THE ENTIRETY OF THIS ARBITRATION PROVISION SHALL BE NULL AND VOID.

D. Opt-Out Right

You may opt out of this arbitration provision by sending written notice to hello@trussfinancialgroup.com within 30 days of your first use of the Site. If you opt out, the remaining provisions of these Terms will continue to apply.

15. Governing Law and Jurisdiction

These Terms are governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law principles. To the extent litigation is permitted under these Terms (including matters not subject to arbitration), you consent to the exclusive jurisdiction of the state and federal courts located in the State of California.

16. Digital Millennium Copyright Act (DMCA) Notice

If you believe that content on the Site infringes your copyright, please submit a written notice to our designated copyright agent at hello@trussfinancialgroup.com containing: (a) identification of the copyrighted work; (b) identification of the infringing material and its location on the Site; (c) your contact information; (d) a statement of good faith belief that the use is not authorized by the copyright owner, its agent, or the law; and (e) a statement, under penalty of perjury, that the information in the notice is accurate and that you are the copyright owner or are authorized to act on the copyright owner’s behalf.

17. Electronic Communications, TCPA Consent, and SMS Terms

By accessing the Site, providing your contact information, or engaging with any of our communications channels, you consent to receive electronic communications from Truss Financial, including email, SMS and text messages, in-app notifications, automated voice calls, AI-generated voice calls, and notices posted on the Site. You agree that all agreements, notices, disclosures, and other communications provided electronically satisfy any legal requirement that such communications be provided in writing.

A. TCPA Prior Express Written Consent

By providing your mobile telephone number to Truss Financial through any form, application, verbal authorization, or other channel, you provide your prior express written consent under the Telephone Consumer Protection Act (TCPA) and applicable Federal Communications Commission (FCC) rules to receive telephone calls and text messages from Truss Financial and its authorized service providers, including calls and messages placed using an automatic telephone dialing system, prerecorded voice, artificial voice generated by artificial intelligence, or automated text messaging system, at the number you provided. This consent is not a condition of any purchase or of receiving any mortgage product or service. Standard message and data rates may apply.

B. Types of Communications

Communications you may receive include loan application updates, document and verification requests, appointment scheduling and confirmations, rate and market updates, customer service follow-ups, and marketing or promotional messages relating to our products and services. Some communications may be drafted, sent, or placed by AI systems on our behalf. Replies you send to those communications may be read, interpreted, and routed by AI systems before being reviewed by a human team member.

C. Revocation of Consent

You may revoke your consent to receive automated calls and text messages at any time by replying STOP to any text message you receive from us, by informing the agent on a call, or by contacting us at hello@trussfinancialgroup.com. Revoking consent for marketing communications will not affect transactional or service-related communications necessary to process or service your loan application or existing accounts. Revocation does not affect the validity of communications sent prior to our processing of your request.

E. Eligible Carriers and Delivery

Truss Financial is not responsible for delays, failures, or errors in the delivery of any text message or call, including those resulting from your carrier, device, settings, or service interruptions. SMS service is available on most major United States carriers.

18. Severability

If any provision of these Terms is held to be invalid, illegal, or unenforceable by a court of competent jurisdiction, that invalidity will not affect the remaining provisions, which will continue in full force and effect to the maximum extent permitted by law.

19. Entire Agreement

These Terms, together with our Privacy Policy and any other agreements you have entered into with Truss Financial in writing, constitute the entire agreement between you and Truss Financial with respect to your use of the Site, and supersede all prior or contemporaneous understandings, agreements, representations, and warranties, whether written or oral, regarding the Site.
