4. No Guarantee of Loan Approval; Not a Commitment to Lend

Nothing on the Site constitutes a commitment, agreement, or guarantee to extend credit, approve a loan, or provide any specific terms, rates, or conditions. All loan programs, interest rates, and terms displayed on the Site are subject to change without notice and are provided for informational purposes only.

Rate quotes, pre-qualifications, and calculator results generated through the Site are estimates only and do not represent a formal loan offer, approval, or commitment. All loans are subject to credit approval, underwriting requirements, property appraisal, and applicable regulatory guidelines. Truss Financial Group is a mortgage broker and not a direct lender.

5. Use of Interactive Tools and Calculators

6. Borrower Portal and Account Access

You are granted a limited, non-exclusive, non-transferable, revocable license to access and use the Site for personal, non-commercial purposes in accordance with these Terms.

9. Third-Party Links and Services

The Site may contain links to third-party websites, applications, or services that are not owned or controlled by Truss Financial Group. We are not responsible for the content, privacy practices, or availability of any third-party sites. Inclusion of a link does not imply endorsement or affiliation. Your use of any third-party site is at your own risk and subject to that site's terms and policies

10. Disclaimers

THE SITE AND ALL CONTENT, TOOLS, AND SERVICES PROVIDED THROUGH IT ARE OFFERED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED. To the fullest extent permitted by applicable law, Truss Financial Group disclaims all warranties, including but not limited to implied warranties of merchantability, fitness for a particular purpose, non-infringement, and accuracy.

We do not warrant that the Site will be uninterrupted, error-free, secure, or free of viruses or other harmful components. We do not guarantee the accuracy, completeness, or timeliness of any information, rates, calculations, or content displayed on the Site.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, TRUSS FINANCIAL GROUP, LLC, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AFFILIATES, AND LICENSORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF OR INABILITY TO USE THE SITE, INCLUDING BUT NOT LIMITED TO LOSS OF REVENUE, PROFITS, DATA, OR BUSINESS OPPORTUNITIES, REGARDLESS OF THE THEORY OF LIABILITY.

In no event shall our total aggregate liability to you for all claims arising out of or related to the Site or these Terms exceed one hundred dollars ($100.00).

12. Indemnification

You agree to indemnify, defend, and hold harmless Truss Financial Group, LLC, its officers, directors, employees, agents, affiliates, and licensors from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) your use of the Site; (b) your violation of these Terms; (c) your violation of any applicable law or regulation; or (d) any information you submit through the Site.

13. Dispute Resolution and Binding Arbitration

A. Agreement to Arbitrate

You and Truss Financial Group agree that any dispute, claim, or controversy arising out of or relating to these Terms, the Site, or any services provided by Truss Financial Group (collectively, "Disputes") shall be resolved exclusively through final and binding arbitration, rather than in court, except that either party may bring individual claims in small claims court if the claims qualify.

B. Arbitration Rules and Forum

Arbitration shall be administered by the American Arbitration Association ("AAA") under its Consumer Arbitration Rules then in effect. Arbitration will take place in the State of California, unless the parties mutually agree to an alternative location or virtual proceeding. The arbitrator's decision shall be final and binding and may be entered as a judgment in any court of competent jurisdiction.

C. Class Action Waiver

YOU AND TRUSS FINANCIAL GROUP AGREE THAT EACH PARTY MAY BRING DISPUTES AGAINST THE OTHER ONLY IN AN INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTION. If this class action waiver is found to be unenforceable, then the entirety of this arbitration provision shall be null and void.

D. Opt-Out Right

You may opt out of this arbitration provision by sending written notice to hello@trussfinancialgroup.com within 30 days of your first use of the Site. If you opt out, the remaining provisions of these Terms will continue to apply.

14. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law principles. To the extent that litigation is permitted under these Terms (including matters not subject to arbitration), you consent to the exclusive jurisdiction of the state and federal courts located in the State of California.

15. Digital Millennium Copyright Act (DMCA) Notice

If you believe that content on the Site infringes your copyright, please submit a written notice to our designated copyright agent at hello@trussfinancialgroup.com containing: (a) identification of the copyrighted work; (b) identification of the infringing material and its location on the Site; (c) your contact information; (d) a statement of good faith belief that the use is not authorized; and (e) a statement, under penalty of perjury, that the information in the notice is accurate and that you are the copyright owner or authorized to act on their behalf.

16. Electronic Communications Consent

By using the Site or providing your contact information, you consent to receive electronic communications from Truss Financial Group, including emails, SMS messages (subject to the SMS consent terms in our Privacy Truss Financial Group, LLC | NMLS #123456 | Terms of Use | Page 5 Policy), and notices posted on the Site. You agree that all agreements, notices, disclosures, and other communications provided electronically satisfy any legal requirement that such communications be in writing.

17. Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, such invalidity shall not affect the remaining provisions, which shall continue in full force and effect.

18. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Truss Financial Group with respect to your use of the Site, and supersede all prior or contemporaneous understandings, agreements, representations, and warranties, whether written or oral, regarding the Site.
